Tenants of St. Louis property allege landlords did not repay them for building garage

ST. LOUIS – Two tenants of a St. Louis property allege their landlords failed to reimburse them for the costs associated with constructing a garage.

Kathleen W. Herring and Daniel J. Sheerin filed a complaint on June 5 in the St. Louis 22nd Judicial Circuit Court against John T. Burghoff and Colleen M. Burghoff alleging breach of oral promise, unjust enrichment and other counts.

According to the complaint, the plaintiffs allege that during their tenancy at the defendants' St. Louis apartment, they made several improvements to the dwelling, including the construction of a garage for $58,624.91. They allege the defendants promised to reimburse them for the costs of the garage but have not done so.

The plaintiffs hold John T. Burghoff and Colleen M. Burghoff responsible because the defendants allegedly retained the benefits of plaintiffs' expenditures for the construction of a new garage without repaying the same.

The plaintiffs request a trial by jury and seek judgment against the defendants in the sum of $58,624.91, plus prejudgment interest, costs and expenses and all other relief that is just and proper. They are represented by Hardy C. Menees and Robert H. Mennes of Menees, Menees & Wynne in Kirkwood.
