Allegedly injured driver seeks coverage from Allstate Insurance

ST. LOUIS – A man is seeking underinsured motorist coverage from his insurance company over damages allegedly incurred in an auto accident.

Matthew Labarge filed a complaint on June 7 in the St. Louis Circuit Court against Allstate Insurance Co. seeking underinsured motorist coverage.

According to the complaint, the plaintiff alleges that on Oct. 7, 2017, he was injured in an auto accident due to the carelessness of an underinsured motorist on U.S. 54. He alleges he suffered permanent and progressive injuries to neck and back. 

The suit states the plaintiff settled his claim within the policy limits of the at-fault driver's insurer with the consent of defendant. He is now claiming underinsured motorist coverage under the policy issued by defendant because his damages allegedly exceeded the at-fault driver's policy limit.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount between $25,000 and $75,000, plus costs of court and all other relief that are just and proper. He is represented by Eric A. Ruttencutter and Robert H. Pedroli of Pedroli & Gauthier in Clayton.
