Injured motorist seeks declaration regarding coverage under American Family Mutual Insurance policies

ST. LOUIS – An insured motorist is seeking declaration from the court regarding uninsured motorist coverage after a collision.

Cindy Waldrop filed a complaint on June 6 in the St. Louis Circuit Court against American Family Mutual Insurance Co. seeking declaratory judgment.

According to the complaint, the plaintiff alleges that on August 19, 2014, she was injured in an automobile accident due to the negligence of Justin Haile, an uninsured motorist. She alleges at the time of the collision, she had three policies with the defendant that provided uninsured motorist coverage with a combined policy limit of $300,000.

The plaintiff holds American Family Mutual Insurance Co. responsible because the defendant allegedly refused to provide the full benefits on the policies to which plaintiff is entitled.

The plaintiff requests the court to declare the rights and obligations of the parties under the policies and such other and further relief to which she is entitled. She is represented by Brent E. Labovitz and Scott L. Kolker of DeFeo and Kolker LLC in Clayton.
