Man alleges Farmers Insurance breached contract by refusing to pay underinsured motorist claim

St. LOUIS – A St. Louis County man is seeking underinsured motorist coverage from his insurer.

Jeffrey Schmeiderer filed a complaint on June 15 in the St. Louis Circuit Court against Farmers Insurance Co. alleging breach of contract.

According to the complaint, the plaintiff alleges that on Oct. 21, 2014, he was injured when his vehicle was struck by an underinsured motorist, Donald Wayne Lipsey II, on Landsdowne Avenue in St. Louis County. He alleges he suffered injuries to his neck, back, shoulders, right elbow and stomach and incurred health care expenses of more than $27,000. 

At the time of the collision, the insurance policy provided by defendant to the plaintiff was in full force and effect, the suit states. The plaintiff alleges that the defendant has failed and refused his demand to pay additional damages under the underinsured motorist coverage policy.

The plaintiff seeks judgment against the defendant, plus penalties, interest, costs and all other additional relief as warranted under the premises. He is represented by Thomas P. Germeroth of The Germeroth Law Firm LLC in Clayton.
