Guest seeks more than $25,000 from State of the Art for the Developmentally Disabled over chair collapse

ST. LOUIS – A woman alleges she was injured at an adult daycare facility in St. Louis when the chair she was using collapsed.

Janice Butler filed a complaint on June 26 in the St. Louis Circuit Court against the State of the Art for the Developmentally Disabled alleging premises liability.

According to the complaint, the plaintiff alleges that on Dec. 6, 2016, she injured her back at defendant's daycare facility when the chair provided by defendant suddenly collapsed, causing her to fall. She alleges she was caused pain and suffering, disability and mental anguish and incurred medical expenses of more than $7,000 as a result. 

The plaintiff holds State of the Art for the Developmentally Disabled responsible because the defendant allegedly failed to provide adequate seating for all attendees, failed to inspect the premises for hazardous conditions and failed to warn invitees of any dangerous condition.

The plaintiff seeks judgment against the defendant in an amount of more than $25,000. She is represented by Arthur C. Shivers of The Law Offices of Arthur C. Shivers LLC in St. Louis.
