Pedestrian alleges cover for hole at Hytopa was broken, caused fall

ST. LOUIS – A St. Louis woman alleges she was injured at a property in the city when she stepped into an uncovered water access hole and fell.

Amy L. Elliott filed a complaint on June 24 in the St. Louis Circuit Court against Hytopa LLC alleging negligence.

According to the complaint, the plaintiff alleges that on Feb. 28, she was injured while walking on the sidewalk at defendant's premises when her foot became trapped in an open hole that caused her to fall. She alleges the hole was for water access and that the metal cover for it had rusted, cracked and broke.

The plaintiff holds Hytopa LLC responsible because the defendant allegedly failed to exercise reasonable care to discover the dangerous condition, failed to repair or replace the broken cover or to provide adequate warning about it.

The plaintiff seeks judgment against the defendant in a fair and reasonable sum of more than $25,000, plus interest, costs and such other and further relief as the court deems necessary and just. She is represented by Michael C. Seamands of Law Offices of Michael C. Seamands LLC in St. Louis.
