Tenant alleges landlords sold property without offering him opportunity to purchase it

ST. LOUIS – A St. Louis County man is seeking declaration that he is entitled to lawful ownership of a property he leases.

Fahmi Abukanan filed a complaint on July 11 in the St. Louis Circuit Court against Khadim Alkhalid, Robin Lowry and Said Alshemisawi alleging breach of contract.

According to the complaint, the plaintiff alleges that on March 17, 2016, he entered into a lease agreement with Alkhalid and Lowry, former owners of 4661 Virginia Ave. in St. Louis, with the opportunity to purchase the property if it was up for sale.

The suit states Alkhalid and Lowry sold the property to Alshemisawi in March and did not allow the plaintiff to exercise his right of first refusal to purchase it.

The plaintiff holds Alkhalid, Lowry and Alshemisawi responsible because defendants Alkhalid and Lowry allegedly sold the property to defendant Alshemisawi without his knowledge.

The plaintiff seeks judgment in his favor, declaring that the property be sold to him under the same terms and conditions provided to defendant Alshemisawi and award for costs, expenses and all other relief that are proper and just. He is represented by Jay L. Kanzler Jr. of Witzel, Kanzler & Dimmitt LLC in St. Louis.
