ST. LOUIS – A Missouri man and his wife are seeking damages from a towing company and a motor club after he fell from a towing truck.

Mark Davis and Linda Davis filed a complaint on July 17 in the St. Louis Circuit Court against Pippin Towing & Recovery LLC and Automobile Club of Missouri alleging negligence.

According to the complaint, the plaintiffs allege on June 3, Mark Davis experienced mechanical problems with his motorcycle and called Automobile Club of Missouri for towing services, who dispatched Pippin Towing. He alleges Pippin Towing's tow truck operator did not have the necessary and appropriate equipment to perform a motorcycle tow and asked him for assistance. The plaintiff alleges he fell from the tow truck bed while attempting to get off and was injured.

The plaintiffs hold Pippin Towing & Recovery LLC and Automobile Club of Missouri responsible because the defendants failed to implement rules requiring tow truck operators only perform motorcycle tows when they have the appropriate equipment.

The plaintiffs request a trial by jury and seek judgment against the defendants in an amount of more than $25,000, plus costs and all other relief that are proper and just. They are represented by Thomas E. Schwartz and Rebecca E. Grossman of Holloran Schwartz & Gaertner LLP in St. Louis.
