CJV Properties alleged to have failed to disclose lead-based paint in property to buyer

ST. LOUIS – The buyer of a property of 18 single-family units in St. Louis alleges that the seller falsely disclosed that the property did not have any lead-based hazards.

LindCrest Properties LLC filed a complaint on July 16 in the St. Louis Circuit Court against CJV Properties LLC, Christopher Vogelsang and Janette Vogelsang alleging breach of contract and fraud.

According to the complaint, the plaintiff alleges that on Jan. 9, 2017, the plaintiff entered into a special sale contract with defendant CJV for the purchase of the property located at 3862-3866 S. Spring Ave., St. Louis. The plaintiff alleges that CJV signed a disclosure that stated it had no reports of lead-based paint or lead-based hazards in the property.

In reviewing the leases, the plaintiff alleges it discovered a disclosure on lead-based paint was included in a previous lease signed by Christopher Volgesang in 2014 and the Department of Public Safety notified KGV Properties in 2009 of the lead paint hazard at 11 separate areas of the property. 

As a result of lead-based paint on the property, the plaintiff alleges it was forced to cleanup and renovate the property in order to comply with the health department. 

The plaintiff holds CJV Properties LLC, Christopher Vogelsang and Janette Vogelsang responsible because CJV allegedly knew that the representations made in the disclosure were false.

The plaintiff requests a trial by jury and seeks actual damages of more than $25,000, plus interest, costs, attorney fees and all other relief that are proper and just. It is represented by Nicholas K. Meador of Koller & Meador LLC in St. Louis.
