Man allege PepsiCo terminated him because of disability

ST. LOUIS – A former PepsiCo driver alleges he was terminated because of his disability.

Wendell Harrington filed a complaint on July 9 in the St. Louis Circuit Court against PepsiCo Inc. and Pepsi Beverages Co. alleging that they violated the Americans with Disabilities Act.

According to the complaint, the plaintiff began his employment with the defendants in 2003. In November 2016, the suit states he went on disability leave due to a back condition and is permanently prohibited from lifting more than 25 pounds. He alleges he requested to be reassigned to a new position that could accommodate his weight restrictions, but was not reassigned. The suit states he was terminated Feb. 5.

The plaintiff holds PepsiCo Inc. and Pepsi Beverages Co. responsible because the defendants allegedly subjected him to adverse employment actions and terminated him because of his disability.

The plaintiff seeks judgment against the defendants of more than $25,000, plus costs, attorney's fees and all other relief that is proper and just. He is represented by Douglas Ponder and Jaclyn M. Zimmermann of Ponder Zimmermann LLC in St. Louis.
