ST. LOUIS – An injured motorist alleges her insurer failed to pay her claim without reasonable cause.

Jamica Burrage filed a complaint on July 18 in the St. Louis 22nd Judicial Circuit Court against Liberty Mutual Insurance Co. alleging breach of contract and vexatious refusal to pay.

According to the complaint, the plaintiff alleges that on Feb. 21, her vehicle was rear-ended while she was stopped at a red light and the car that caused the collision fled the scene. At the time of the accident, she alleges she was covered under a policy issued by the defendant for which she made a demand for uninsured motorist benefits.

The plaintiff holds Liberty Mutual Insurance Co. responsible because the defendant allegedly failed and refused to pay out the uninsured motorist benefits due to plaintiff.

The plaintiff seeks judgment against the defendant in an amount between $25,000 and $75,000, plus costs and such other just and proper relief. She is represented by Kevin A. Sullivan of Sauter Sullivan LLC in St. Louis.
