Client seeks more than $1 million from St. Louis attorney over allegations appeal was not timely filed

ST. LOUIS – An Arnold man alleges a St. Louis attorney failed to timely file an appeal with the Missouri Supreme Court.

Donald Davis filed a complaint on July 13 in the St. Louis 22nd Judicial Circuit Court against John T. Papa alleging legal malpractice.

According to the complaint, the plaintiff alleges that on Jan. 7, 2011, he hired defendant to represent him in a Federal Employers' Liability Act case. The suit states a jury trial ruled in favor of the defendant in the case in 2013 and no damages were awarded to the plaintiff. The suit states Papa appealed the case to the Missouri Court of Appeals, which upheld the ruling, and told the plaintiff he would appeal to the Missouri Supreme Court. 

The plaintiff alleges Papa never filed the case with the Supreme Court and the time limit has expired.

The plaintiff seeks judgment against the defendant in an amount of no less than $1.6 million and whatever relief that may be just and reasonable. He is represented by Nancy R. Richards of Nancy R. Richards & Associates in Festus.
