ST. LOUIS – A credit union alleges an insurance company failed to indemnify it in a lawsuit.
Anheuser Busch Employee Credit Union filed a complaint on July 16 in the St. Louis Circuit Court against Traveler's Property Casualty Co. of America and Charter Oak Fire Insurance Co. alleging breach of contract.
According to the complaint, the plaintiff purchased an umbrella policy from Travelers beginning in 2014. The suit states the plaintiff sued an individual in 2015 regarding a vehicle it repossessed and sold at auction, and the individual filed a counter-claim and class action claims. The plaintiff alleges it provided notice of the counter-claim to Travelers and made a demand for it to defend the plaintiff, but Travelers did not.
The suit states a settlement agreement was later reached between the plaintiff and the parties in the suit.
The plaintiff holds Traveler's Property Casualty Co. of America and Charter Oak Fire Insurance Co. responsible because Travelers allegedly breached the contract with its failure to defend and indemnify it.
The plaintiff requests a trial by jury and seeks judgment against the defendants of more than $25,000, plus interest, costs, attorney's fees and all other relief that is just and proper. It is represented by David E. Larson of Martin, Pringle, Oliver, Wallace & Bauer LLP in Kansas City.
