Tenant of St. Louis property alleges railing failed and caused him to fall

ST. LOUIS – A tenant of a St. Louis property alleges his landlord failed to repair railing that caused him to fall.

David J. Washington filed a complaint on July 26 in the St. Louis Circuit Court against Damon Roberson alleging negligence.

According to the complaint, the plaintiff alleges that on Aug. 17, 2017, he was a tenant at defendant's property at 2121 Salisbury St., St. Louis and fell when the balcony railing failed. He alleges he suffered injuries to his back, ribs, hand, leg, head and body as a whole as a result of the fall. 

The plaintiff holds Roberson responsible because the defendant allegedly failed to timely and properly inspect, repair and/or replace the damaged railing of the balcony and failed to give adequate warning of the unsafe condition of the balcony.

The plaintiff seeks judgment against the defendant in a fair and reasonable amount of more than $25,000, plus costs and all other relief that are just and proper. He is represented by James P. Lemonds and Steve W. Duke of Brown & Crouppen PC in St. Louis.
