Parents file wrongful death suit against Geneva Apartments owner over son's death

ST. LOUIS – The parents of a man killed at a St. Louis apartment complex allege the complex's owners failed to fix the broken lock on a door that allowed the assailant in.

Jose Garcia Sr. and Celsa Garcia filed a complaint on July 25 in the St. Louis 22nd Judicial Circuit Court against National Real Estate Management Corp., doing business as Geneva Apartments, and Adnan Husidic alleging wrongful death.

According to the complaint, the plaintiffs allege that on March 10, 2016, their son, Jose Garcia Jr., was with his girlfriend, Ashley Triplett, in her apartment at Geneva Apartments when he was met by Triplett's former boyfriend, defendant Huisidic, who shot and killed him.

The plaintiffs allege Huisidic had access to the apartment complex because National Real Estate Management Corp. failed to maintain a functioning lock on its exterior doors.

The plaintiffs hold National Real Estate Management Corp. and Husidic responsible because defendant Geneva Apartments allegedly failed to fix the broken lock and negligently allowed a dangerous third party to enter and remain in its premises and Husidic's alleged assault and touching of the decedent was unlawful and unjustified.

The plaintiffs request a trial by jury and seek judgment against each defendant in a sum of more than $25,000, plus costs and all other relief that are proper and just. They are represented by John G. Simon, Kevin M. Carnie Jr. and Patrick R. McPhail of The Simon Law Firm PC in St. Louis.
