St. Louis consumer alleges sales contract for vehicle is void because title wasn't provided

ST. LOUIS – A St. Louis consumer alleges a financing company falsely represented that she was obligated to pay for a vehicle purchased on a void retail installment contract.

Sherri Cole-Neal filed a complaint on July 31 in the St. Louis Circuit Court against Nationwide Cassel LLC alleging violation of the Missouri Merchandising Practices Act.

According to the complaint, the plaintiff alleges that in October 2017, she made a down payment to Autoway Car Sales LLC for the purchase of a 2010 Buick LaCrosse CXL without the title. She alleges Autoway never assigned or delivered the title and that she was told to make payments to Nationwide Cassel. She alleges Nationwide Cassel does not have a valid right to collect payments from her because the sale is fraudulent and void.

The plaintiff holds Nationwide Cassel LLC responsible because the defendant allegedly failed to inform her that the sale was void because no title was provided, forced her to pay on a void installment sales contract and failed to immediately refund all money paid when the dealer did to provide the valid title.

The plaintiff seeks an order declaring the sale was fraudulent and void and that she has no obligation to make any payments, award for costs and all other relief that is just and equitable. She is represented by Terry L. Lawson Jr. of Legal Services of Eastern Missouri in St. Louis.
