Mark Twain Hotel tenant alleges he was injured in ceiling collapse

ST. LOUIS – A tenant of a St. Louis property alleges he was injured when the ceiling collapsed on him in his apartment.

Arthur Birk filed a complaint on Aug. 8 in the St. Louis Circuit Court against Mark Twain Hotel Partners alleging negligence.

According to the complaint, the plaintiff alleges that on Jan. 22, he was using the shower at his apartment defendant's Mark Twain Hotel at 205 North Ninth St., St. Louis when the ceiling suddenly collapsed and fell on him. He alleges he suffered injuries to his back and right knee and incurred medical expenses of more than $25,000 as a result of the ceiling collapse. 

The plaintiff alleges that prior to the ceiling collapse, he reported to the defendant that he heard a dripping noise in his apartment.

The plaintiff holds Mark Twain Hotel Partners responsible because the defendant allegedly breached its duty of ordinary care to remedy the dangerous condition of the pipes.

The plaintiff seeks judgment in his favor in an amount greater than $25,000, plus costs and all other relief that is just and equitable. He is represented by Kyle Kleefus of Law Offices of Derald L. Gab PC in St. Louis.
