Tenant of St. Louis apartment building alleges water, cleaning substances in lobby caused fall

ST. LOUIS – A tenant of a St. Louis apartment building alleges the owner failed to maintain the lobby where he fell in a safe condition.

Wilmer Benge filed a complaint on Aug. 22 in the St. Louis 22nd Judicial Circuit Court against Whitney Pointe 400 LLC alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 17, 2017, he was injured at defendant's apartment building when he slipped and fell in the lobby due to accumulated water and cleaning substances on the floor. He alleges he suffered injuries to his back, legs and knees as a result of the fall. 

The plaintiff holds Whitney Pointe 400 LLC responsible because the defendant allegedly failed to ensure that there was no unreasonably dangerous condition present in the premises and failed to give adequate warning of any dangerous condition.

The plaintiff seeks judgment in his favor in an amount greater than $25,000, plus costs and all other relief that is just and proper. He is represented by Peter P. Fiore Jr. and Alvin C. Paulson in St. Louis.
