Broadcast company faces copyright lawsuit over Howie Mandel photo

Minnesota-based Hubbard Broadcasting owns KSLX-FM in Arizona, which allegedly used the photo.

ST. LOUIS — A photographer accuses a radio station website of stealing a copyrighted photo of Howie Mandel.

Joey Carman filed a complaint on Aug. 27 in the U.S. District Court for the Eastern District of Missouri against Hubbard Broadcasting, alleging violations of copyright law. 

According to the complaint, the website of Arizona-based classic rock station KSLX-FM used Carman's photo of Howie Mandel to promote the comedians appearance at a nearby casino. Carman, who registered the photo with the U.S. Copyright Office, claims the website intentionally reproduced and posted the photo to boost profits.

Minnesota-based Hubbard Broadcasting owns KSLX-FM and several other TV and radio stations. The company has five radio stations in St. Louis, including New Country 92.3, rock station KSHE 95, and 105.7 The Point.

Carman seeks damages, pre-judgment interest and profits from Hubbard Broadcasting due to the alleged copyright infringement. He is represented by Richard Liebowitz of the Liebowitz Law Firm in Valley Stream, New York. 

 they have infringed on his copyright of the photograph and Hubbard is in violation of the United States Code pertaining to exclusive rights under copyrights. He is requesting that the court ask Hubbard Broadcasting to account for all profits as a result of the infringement and for any other additional relief that they see fit.

There has been proper verification that Carman had registered the photograph properly with the U.S. Copyright Office and Carman has been the only owner of the photograph since it was taken.
