ST. LOUIS – A Perryville widow alleges she is entitled to $114,000 for accidental death benefits under her late husband's insurance policy.

Krystal Dawn Lohmann filed a complaint on Sept. 6 in the St. Louis 22nd Judicial Circuit Court against Life Insurance Co. of North America, et al. alleging breach of contract.

According to the complaint, the plaintiff alleges that on Aug. 7, 2008, her husband died from self-hanging death that was ruled as a suicide by the county coroner. On Sept. 11, 2008, she was paid $114,000 pursuant to provisions of the Group Term Life Insurance of the policy, the suit states. 

She alleges she filed a claim for accidental death benefits and provided medical documentation from her husband's physicians that he suffered from depression and paranoia, but the defendants denied her claim.

The plaintiff holds Life Insurance Co. of North America, et al. responsible because their refusal to pay the accidental death benefits allegedly constitutes a breach of the insurance contract.

The plaintiff seeks judgment against the defendants in an amount that is fair and reasonable, attorney's fees and costs. She is represented by Sean W. Westhoff of Westhoff Law in Arnold.
