D&H Trucking, driver sued for more than $25,000 over I-44 collision

ST. LOUIS – A driver alleges she was injured when a tractor-trailer entered her lane and caused a collision in St. Louis.

Davionna Holmes filed a complaint on Sept. 4 in the St. Louis 22nd Judicial Circuit Court against Dustin Kidwell and D&H Trucking Co. Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on Sept. 2, 2016, she was driving a 2016 Jeep Patriot traveling east on Interstate 44 near the Nebraska Avenue bridge in St. Louis when defendant Kidwell, a D&H employee, unlawfully caused the tractor-trailer he was driving to collide with plaintiff's vehicle. She alleges she suffered injuries to her neck, back, legs, knees and ankles and incurred damages of more than $25,000 as a result of the collision.

The plaintiff holds Kidwell and D&H Trucking Co. Inc. responsible because defendant Kidwell allegedly failed to keep proper control of his vehicle, failed to keep a proper lookout for other vehicles and negligently and carelessly attempting to move his vehicle into the plaintiff's lane.

The plaintiff requests a trial by jury and seeks judgment against the defendants in a reasonable amount of more than $25,000, plus costs and all other relief that are proper and just. She is represented by Daniel C. Katzman of Katzman & Sugden LLC in Belleville, Illinois.
