ST. LOUIS – A woman struck and injured in a Walmart parking lot alleges that her insurer's offer is "woefully inadequate" considering her injuries.
Ashley Smith filed a complaint in the St. Louis 22nd Judicial Circuit Court against Allstate Fire & Casualty Insurance Co. alleging breach of insurance contract and vexatious refusal to pay.
According to the complaint, the plaintiff alleges that on Oct. 2, 2015, she was a pedestrian in a Walmart parking lot and was hit by an underinsured driver. She alleges she suffered severe and disabling injuries to her neck, back and knee and incurred medical expenses of more than $22,000.
After receiving $25,000 settlement from the underinsured driver's insurer, the suit states the plaintiff brought a claim for underinsured motorist coverage against the defendant.
The plaintiff holds Allstate Fire & Casualty Insurance Co. responsible because the defendant allegedly offered only $5,000 on her underinsured motorist claim instead of the requested policy limit of $25,000.
The plaintiff requests a trial by jury and seeks judgment against the defendant for the policy limit of $25,000, plus interest, costs and all further relief that is proper and just. She is represented by Matthew J. Sauter of Sauter Sullivan LLC in St. Louis.
