Union Pacific Railroad contractor alleges he was not provided safe area to change crews

ST. LOUIS – A conductor alleges he needed surgery after a fall while on the job.

George Kavanaugh Jr. filed a complaint on Sept. 25 in the St. Louis Circuit Court against Union Pacific Railroad Co. citing the Federal Employers' Liability Act.

According to the complaint, the plaintiff alleges that on March 19, 2016, he was injured when he was required to walk through vegetation and a ditch and fell while working as a conductor for the defendant. He alleges he sustained injuries to his right hand and wrist that required surgery.

The plaintiff holds Union Pacific Railroad Co. responsible because the defendant allegedly failed to provide a reasonably safe place to work, failed to provide a safe walkway and failed to provide a safe place to change crews.

The plaintiff requests a trial by jury and seeks judgment against defendant for a sum of more than $25,000, plus costs. He is represented by Nelson G. Wolff and Scott M. Gershenson of Schlichter Bogard & Denton in St. Louis.
