Injured pedestrian suing over State Farms offer of more than $47,000 for $100,000 claim

ST. LOUIS – A pedestrian struck by a vehicle in 2016 is seeking damages from her insurer over its offer to settle her claim.

Demonica Mims filed a complaint on Oct. 4 in the St. Louis Circuit Court against State Farm Mutual Automobile Insurance Co. alleging breach of contract and vexatious refusal to pay.

According to the complaint, the plaintiff alleges that on Nov. 6, 2016, she was a pedestrian attempting to cross the street near 79 Meadowbrook Country Club Estates in Baldwin when she was struck by the vehicle driven by Brandon Eckoff, who fled the scene of the collision. 

She alleges she sustained injuries and incurred medical bills of more than $50,000 and on May 31, she submitted a claim for underinsured motorist coverage. 

The plaintiff holds State Farm Mutual Automobile Insurance Co. responsible because the defendant allegedly denied her claim for payment of $100,000 and has only offered $47,504.17 to settle her claim.

The plaintiff requests a trial by jury and seeks judgment against defendant in an amount of more than $25,000, plus costs, and all other relief that are appropriate. She is represented by Aaron M. Vogel of Schultz & Myers in St. Louis.
