Wheelchair alleges broken legs caused by driver's negligence, failure to secure chair

ST. LOUIS – A wheelchair user alleges both of her legs were broken when the driver of a transport van hit the brakes and caused her fall out of her chair.

Theresa Fehrmann filed a complaint on Sept. 27 in the St. Louis Circuit Court against All Care Transport Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on June 20, 2017, she was a passenger in a transport van owned by defendant. While traveling in the area of South Kingshighway and Manchester Road, the van's driver allegedly slammed on the brakes, causing her to fall forward out of her wheelchair and be injured. She alleges she experienced severe pain was hospitalized and spent months with cast on both legs as a result.

The plaintiff holds All Care Transport Inc. responsible because defendant's driver failed to keep proper lookout and failed to maintain proper control of the vehicle he was driving and failed to safely secure her wheelchair.

The plaintiff requests a trial by jury and seeks actual, punitive and exemplary damages; costs; and all other relief that is proper and just. She is represented by David W. Terry of Terry Law Firm LLC in St. Louis.
