Farmers Insurance alleged to have failed to pay underinsured motorist claim without reasonable cause

ST. LOUIS – Two people injured in a collision with an underinsured driver allege their insurance company has refused to pay their claim for benefits.

Julia Battle and Jabalia Battle filed a complaint on Oct. 16 in the St. Louis Circuit Court against Farmers Insurance Co. Inc. alleging refusal to pay.

According to the complaint, the plaintiffs allege that on Oct. 18, 2017, they were injured in an automobile collision at or near the intersection of Natural Bridge and Edmundson roads in Missouri due to the negligent act of an underinsured driver. The plaintiffs allege they incurred damages in excess of the at-fault driver's policy limits and made a claim for the underinsured motorist coverage pursuant to the insurance policy issued by the defendant. 

The plaintiffs hold Farmers Insurance Co. Inc. responsible because the defendant allegedly refused to pay for their losses without reasonable excuse or cause.

The plaintiffs request a trial by jury and seek judgment in their favor in an amount of more than $75,000 for each of them, with statutory damages, and all other remedies that may be appropriate. They are represented by Scott L. Kolker of Kolker & Labovitz in Clayton.
