Property owner is suing for unlawful foreclosure

ST. LOUIS — A property owner is suing St. Louis Bank, et al., citing alleged unlawful foreclosure.

Dwayne Tiggs filed a complaint on Oct. 15, in the St. Louis Circuit Court, against the defendants alleging that they violated the Missouri Rule of Civil Procedure.

According to the complaint, the plaintiff alleges that he is the owner of property located at 3167 California Ave. in St. Louis. 

He alleges he will be irreparably harmed should defendants proceed with the sale of his property. 

The plaintiff holds St. Louis Bank, et al., responsible because the defendants allegedly refused to provide an accounting of fees, denied his right to cure and/or to redeem the property and wrongfully placed his property up for a foreclosure sale.

The plaintiff requests a trial by jury and seeks a temporary restraining order enjoining defendants from executing a successor trustee sale and from taking possession of his property, award for all damages, and all other general and equitable relief.
