ST. LOUIS – A surviving spouse of a woman killed when a piece of concrete from a bridge barrier fell on her car is seeking damages from the driver who struck the barrier and his insurance company.
Joseph Mokwa, individually and on behalf of the estate of Janet Torrisi-Mokwa, filed a complaint on Oct. 26 in the St. Louis Circuit Court against Demaya Angelou Love and The Cincinnati Insurance Co. alleging wrongful death and vexatious refusal to pay.
According to the complaint, on July 23, Love lost control of her vehicle while attempting to make a right turn onto Lindell Boulevard from Union Boulevard and struck the curb, electric signal and bridge barrier. The suit states the barrier broke apart, causing concrete pieces to fall onto Forest Park Parkway below. The suit states Torrisi-Mokwa died when her vehicle, which was traveling on Forest Park Parkway, was struck with a 2,900-pound piece of concrete.
The suit states at the time of the accident, the plaintiff had a policy of insurance with Cincinnati Insurance and the plaintiff has made a demand for payment under the uninsured coverage section of the policy.
The plaintiff holds Love and The Cincinnati Insurance Co. responsible because defendant Love allegedly carelessly operated her vehicle without a proper driver's license or vehicle insurance and carelessly drove the same in a careless and imprudent manner.
The plaintiff requests a trial by jury and seeks judgment against defendant in an amount greater than $25,000, costs and all other relief that is just and proper. He is represented by Neil J. Bruntrager of Bruntrager & Billings PC in St. Louis.
