Allegedly uneven tiles at MetroLink platform blamed for man's fall

ST. LOUIS – A man alleges he was injured on a MetroLink platform because of uneven tiles.

Walter Berry filed a complaint on Oct. 25 in the St. Louis Circuit Court against Bi-State Development Agency alleging negligence.

According to the complaint, the plaintiff alleges that on Nov. 29, 2017, he fell at the defendant's MetroLink westbound platform located at the 8th and Pine Station due to unlevel and uneven tiles. He alleges he suffered serious and permanent injuries to his head, neck, back, left shoulder and right knee as a result of the fall. 

The plaintiff holds Bi-State Development Agency responsible because the defendant allegedly failed to remove or repair the uneven surface and failed to barricade the area or give adequate warning.

The plaintiff requests a trial by jury and seeks judgment against the defendant for more than $25,000, costs and all other relief that is appropriate. He is represented by Eric A. Ruttencutter, Robert H. Pedroli Jr. and Daniel J. Gauthier of Pedroli & Gauthier in Clayton.
