White Knight Diner owners seek judgment regarding subrogation interest in third-party money

ST. LOUIS – Owners of a St. Louis diner damaged by a vehicle collision are seeking a declaration regarding the amount of subrogation interest their insurer has in settlement money they received.

White Knight Diner LLC, Larry Lee Hinds and Karen Freiner filed a complaint on Oct. 18 in the St. Louis Circuit Court against Owners Insurance Co. seeking declaratory judgment.

According to the complaint, the plaintiffs own a building at the corner of 18th and Olive streets in St. Louis that was damaged in March 2015 when two vehicles collided at the intersection and one vehicle crashed into the building. The suit states the plaintiffs operate a diner at the building and it was closed for five weeks for repairs.

The plaintiffs allege they made a claim under their policy with Owners Insurance and have received a payment.

The suit states the plaintiffs made a claim against the drivers that resulted in two settlements totaling $41,331.86. The plaintiffs allege they are holding that money in trust pending determination of the subrogation interest. 

The plaintiffs seek a declaratory judgment determining defendant's subrogation interest in the monies plaintiffs have received from third-party tortfeasors. They are represented by Christopher J.M. Stokes of Christopher Stokes Attorney at Law in St. Louis.
