Hartford Underwriters Insurance alleged to have refused to pay damages under policy without reasonable excuse

ST. LOUIS – A motorist injured in a 2010 collision alleges his insurer failed to pay damages under his insurance policy.

Michael Ruch filed a complaint on Oct. 31 in the St. Louis Circuit Court against Hartford Underwriters Insurance Co. alleging that the licensed insurer failed to pay a payment pursuant to the terms of the insurance policy.

According to the complaint, the plaintiff alleges that on June 28, 2010, he was injured in an auto accident on U.S. 61 at or near its intersection with David Drive due to the carelessness of Allen Gordon, and underinsured driver. 

He alleges he sustained injuries to his neck, back and left upper extremity and incurred damages in excess of the at-fault driver's policy limits. At the time of the occurrence, the suit states the insurance policy issued by defendant was in full force and effect. 

The plaintiff holds Hartford Underwriters Insurance Co. responsible because the defendant allegedly failed and refused to pay damages under the policy without reasonable cause or excuse.

The plaintiff seeks judgment against the defendant in an amount exceeding the jurisdictional limits of the court, costs and all other relief that is proper and appropriate. He is represented by Scott L. Kolker of Kolker & Labovitz in Clayton.
