Tenant alleges Winter Garden Preservation failed to remove ice on sidewalk that caused fall

ST. LOUIS – A tenant of a St. Louis apartment building alleges ice on a sidewalk caused her to fall and tear a rotator cuff.

Denise E. Bennett filed a complaint on Nov. 7 in the St. Louis Circuit Court against Winter Garden Preservation LP alleging negligence.

According to the complaint, the plaintiff alleges that in November 2014, she was exiting her apartment at the defendant's building when she slipped and fell on ice that had accumulated on the sidewalk. She alleges she sustained a torn rotator cuff that required surgical operation as a result of the fall. 

The plaintiff holds Winter Garden Preservation LP responsible because the defendant allegedly failed to ensure the surface was clear and failed to warn of the slippery surface.

The plaintiff requests a trial by jury and seeks judgment against defendant in amount of more than $25,000, costs and all other relief that is just and proper. She is represented by Jeremy A. Gogel of The Gogel Law Firm in St. Louis.
