Injured motorist alleges State Farm Insurance failed to pay claim

ST. LOUIS – A Franklin County man alleges his insurer has failed to pay his claim for underinsured motorist benefits.

Justin Childs filed a complaint on Nov. 9 in the St. Louis Circuit Court against State Farm Insurance Co. alleging vexatious refusal.

According to the complaint, the plaintiff alleges that on Dec. 10, 2016, he was insured under defendant's insurance policy when he was injured when an underinsured motorist collided with his automobile on Highway 141. He alleges he received injuries to his head, brain, face, neck, back and shoulders for which he requested payments from the defendant in accordance with the underinsured motorist coverage in his policy. 

The plaintiff holds State Farm Insurance Co. responsible because despite acceptance of premium payments, defendant failed and refused to issue payment to plaintiff's claim for his demands of the limits of the policy.

The plaintiff requests a trial by jury and seeks judgment against defendant in an amount of the underinsured motorist coverage of the policy, costs, expenses, attorney's fees and such other relief that is fair and reasonable. He is represented by Christopher Longo of Longo Biggs LC in St. Louis.
