Motorist allegedly injured in St. Louis claims American Family Insurance failed to pay reasonable sum

ST. LOUIS – A St. Clair County, Illinois woman is seeking damages from an insurer and an unknown driver over a St. Louis collision.

Chloe Powell filed a complaint on Nov. 16 in the St. Louis Circuit Court against American Family Insurance Co. and John or Jane Doe alleging negligence, breach of contract and vexatious refusal to pay.

According to the complaint, on Aug. 2, 2016, the plaintiff was injured in a motor vehicle accident due to the carelessness of Doe near the intersection of Nebraska and Wyoming streets in St. Louis. She alleges she suffered injuries to multiple parts of the body and incurred damages. On Sept. 1, 2016, the suit states she submitted an uninsured motorist claim under the policy issued by American Family Insurance and it allegedly failed to pay a reasonable sum of money out of the policy.

The plaintiff holds American Family Insurance Co. and John or Jane Doe responsible because defendant Doe's alleged carelessness caused or directly contributed to the plaintiff's damages and American Family Insurance allegedly failed to uphold its contractual obligation.

The plaintiff requests a trial by jury and seeks all damages, attorney's fees, costs, and all other relief that is proper and just. She is represented by Lorenzo A. Hester and Melissa Griffeth of The Hester Group LLC in St. Louis.
