Welder alleges workers' compensation claim factor in termination from Modern Metals

ST. LOUIS – An Illinois man alleges a St. Louis company terminated him from his position as a welder after he filed a workers' compensation claim.

Ryan Gardner filed a complaint on Jan. 4 in the St. Louis Circuit Court against Modern Metals Inc. alleging retaliatory discharge, breach of contract and willful and wanton breach.

According to the complaint, the plaintiff began his employment with the defendant in January 2018 as a welder and fabricator. He alleges he was injured on the job and filed a workers' compensation claim. The suit states he was terminated June 13, 2018.

The plaintiff holds Modern Metals Inc. responsible because the defendant allegedly failed a refused to provide honest reasons for his termination and terminated him because he filed a workers' compensation claim.

The plaintiff requests a trial by jury and seeks judgment against defendant in an amount greater than $25,000 plus costs, interest and attorney's fees. He is represented by Brian M. Wendler, Angie Zinzilieta and Paul E.H. Rademacher of Wendler Law PC in Edwardsville, Illinois.
