Borrower alleges Apex Credit Union did not provide him with notice of right to cure a loan

ST. LOUIS – A St. Louis man alleges his vehicle was wrongfully repossessed.

Fred Allen filed a complaint on Jan. 4 in the St. Louis Circuit Court against West Community Credit Union alleging conversion.

According to the complaint, the plaintiff alleges that on Aug. 18, 2017, his original creditor, Apex Credit Union, wrongfully took possession of his vehicle after he fell behind on his payments. The suit states the defendant merged with Apex in November 2017.

The plaintiff holds West Community Credit Union responsible because Apex Credit Union allegedly did not provide him with a notice of right to cure the loan and did not provide him with a timely and reasonable notice of disposition of sale.

The plaintiff seeks actual and statutory damages, attorney's fees, costs and all other relief that is equitable and just. He is represented by Robert L. Swearingen of Legal Services of Eastern Missouri in St. Louis.
