Passenger files suit against American Family Mutual Insurance over allegations of vexatious refusal

ST. LOUIS – A passenger injured in a multivehicle collision alleges her insurance company has failed to pay her the amounts owed under her policy.

Winoka Evans filed a complaint on Jan. 18 in the St. Louis Circuit Court against American Family Mutual Insurance Co. alleging breach of contract and vexatious refusal.

According to the complaint, the plaintiff alleges that on Dec. 5, 2015, she was a passenger in a motor vehicle that was involved in a collision with several other motorists. She alleges she suffered serious injuries to her neck and back and has incurred medical expenses and lost wages. 

She alleges at the time of the collision, she was insured under a policy of uninsured motorist coverage with the defendant and provided it with a notice of her claim. She alleges the defendant has failed and refused to pay her the amounts due under the terms of the policy.

The plaintiff seeks judgment against defendant for $100,000, attorney's fees, costs and all other relief deemed just and proper. She is represented by Patrick Hinrichs of The Brady Law Firm in St. Louis.
