ST. LOUIS – An insured driver alleges his insurance company has failed to pay him benefits under the underinsured portion of his insurance policy.
Kyle Haubrich filed a complaint on Jan. 22 in the St. Louis Circuit Court against Safeco Insurance Co. of Illinois alleging breach of contract and vexatious delay.
According to the complaint, the plaintiff alleges that on May 24, 2017, he was involved in an auto collision with a vehicle driven by Jenna Morrison, an underinsured motorist, on Interstate 55 at or near its intersection with Broadway Boulevard in St. Louis.
At the time of the incident, the plaintiff alleges the insurance policy issued by defendant was in full force and effect. He alleges the defendant has failed and refused to pay him benefits, specifically the difference between the damages incurred and the policy limits of Morrison.
The plaintiff requests a trial by jury and seeks judgment against in an amount greater than $25,000, attorney's fees, costs and all other relief that is just and equitable. He is represented by David J. Gregory of The Injury Counsel in St. Louis.
