Cyclist alleges driver failed to keep careful lookout in Forest Park collision

ST. LOUIS – A cyclist alleges he was thrown 15 to 20 feet off of his bicycle when a driver struck him in Forest Park.

James Robert Varner filed a complaint on Feb. 5 in the St. Louis 22nd Judicial Circuit Court against Carl Dollison alleging negligence.

According to the complaint, the plaintiff alleges that in June 27, 2018, he was riding his bicycle on Theatre Drive in Forest Park in St. Louis when the defendant abruptly made a left turn into a parking lot and crashed into plaintiff. The plaintiff alleges the collision caused him to be thrown 15 to 20 feet off of his bicycle. The suit states he suffered injuries to both of his legs, distal radius fracture and a right thumb proximal phalanx fracture. 

The plaintiff holds Dollison responsible because the defendant allegedly failed to keep a careful lookout, failed to sound or give warning of his approach and failed to take evasive maneuvers to avoid the incident.

The plaintiff requests a trial by jury and seeks judgment against defendant in an amount greater than $25,000, with interest, costs and all other relief that is just and proper. He is represented by Mary Simon Timmerman and John Simon of The Simon Law Firm PC in St. Louis.
