Brian Cummings

Nashville attorney Brian Cummings dedicates his life's work to helping people who are injured or those who have lost someone due to the negligence of others.

After spending 15 years as a defense attorney for medical malpractice and personal injury cases, Brian Cummings has switched to the other side of the table. Because of his unique background with experience handling the plaintiff and defense sides of the these types of cases, Cummings understands how insurance companies analyze and evaluate claims. His vast experience analyzing claims and facts allows him to apply this knowledge throughout the litigation process, which allows his clients to focus on rest, recovering and getting back to their daily lives.

Cummings feels that in larger firms, different individuals are assigned to work on a case based on who at the time needs work. This means, in some cases, the attorney that the client actually wanted and/or preferred doesn't always do the type or the amount of work that the client initially expected.

Cummings, on the other hand, only takes on a select number of cases at a time so that he can personally handle every aspect of each one. It is important to him that his clients have assurances that the attorney they chose is the same attorney that handles every aspect of their case. Cummings is a compassionate listener, an invaluable trait to offer his clients, many of whom have endured horrific experiences. He makes sure his clients get his full attention and expertise from start to finish.

Recently, Cummings successfully litigated a case for the husband of a woman who died in her late 30s as a result of her obstetrician-gynecologist’s failure to diagnose early-stage breast cancer. The client's wife had asked her doctor about a physical change in her breast that she identified during a self-exam. The doctor told her it was "nothing to worry about." She trusted her doctor and relied on what she was told. However, a different doctor diagnosed that physical change as breast cancer. By the time the diagnosis came in from the other doctor, the cancer had already spread and she later died of this late-diagnosed cancer. The original doctor's insurance company offered Cummings' client nothing for his wife's death.

Cummings pushed the case to trial and won a favorable verdict for his client. The defendant had the nerve to laugh in front of the jury from his counsel's table on multiple days during the trial. The doctor did not laugh when the jury read its verdict - which exceeded the doctor’s available insurance coverage.

Great outcomes are not uncommon for Cummings, who in just the last three years helping patients and their families has won more than $22 million for his clients.

Cummings is a Board-Certified medical malpractice attorney, which is a recognition possessed only by 14 other plaintiffs attorneys in Tennessee. Cummings has also been selected by SuperLawyers for several consecutive years for representing personal injury/medical malpractice clients.

Cummings is also a senior fellow of The Litigation Counsel of America, which is composed of less than one-half of one percent of American lawyers. He is one of less than 10 attorneys in Nashville with this honor.

Cummings is licensed to practice law in Tennessee, Hawaii, California, Georgia and Florida. He is also admitted to practice before the United States Supreme Court. For more information on Cummings, please visit his website at https://cummingsinjurylaw.com.
