BB&D’s representation of the Home Builders Association of St. Louis and Eastern Missouri (“STL HBA”) resulted in a regulatory victory that will provide significant savings for homebuilders and homebuyers.
With more than 600-member companies, STL HBA members annually invest millions of dollars in water infrastructure donated to water utilities after the completion of a development. Investor-owned water companies previously enjoyed a federal tax exemption for such infrastructure (known as “contributions in aid of construction or “CIAC”), but a little-known change in the Federal Tax Cut and Jobs Act eliminated this exemption.
Without relief from the Missouri Public Service Commission (PSC), this tax would have impacted developers, increasing the cost of every new home by thousands of dollars. BB&D attorneys Robert Blitz, Chris Pieper, and Angela Burkeaggressively pursued relief from the PSC, ultimately securing an order preventing this significant cost from being imposed on homebuilders and their clients.
