Schnucks was deceitful in advertising alcohol on sale, lawsuit says

State Court

ST. LOUIS - The Missouri supermarket chain Schnuck Markets, Inc. is the defendant in a class action lawsuit recently filed in the St. Louis Circuit Court.

The class is represented by plaintiff Leonard Perry, a Missouri resident and frequent patron of the Schnucks stores. Perry says that the supermarket chain is in violation of Missouri retail and consumerism law by offering false and misleading price comparisons on products supposedly on sale.

In the suit, the plaintiff says that Schnucks offered various alcohol products on sale through multiple marketing platforms such as print advertisements, mailers, in-store signage, on the website and printed on receipts. However, the supermarket didn't offer the products for a substantial amount of time at regular prices before the sale, according to the suit.

The lawsuit states that Missouri law prohibits this practice of advertising former price comparisons unless the comparative price is bona fide and not fictitious.

Perry is pressing one count of violation of the Missouri Merchandising Practices Act and one count of unjust enrichment, and is asking the court for damages from the misrepresented bargain and other punitive damages for each member of the class.

The class is represented by Orlowsky Law, LLC.
