ST. LOUIS - The Association of Social Work Boards was sued in federal court on April 14 for allegedly failing to provide testing accommodations for the disabled.
According to the complaint filed in the Eastern Missouri U.S. District Court, plaintiff Joan Rabushka is a licensed master social worker pursuing licensure as a licensed clinical social worker in the State of Missouri.
Rabushka planned to sit for the defendant's licensure exam and says that she filled out all of the required forms and documentation to inform the defendant of her disability that affected her ability to wear a mask and was informed that a private testing room would be provided to accommodate her disability.
The complaint states that the defendant went back on its word and informed plaintiff that she would need to wear a mask to take the exam in accordance with the test administrator's COVID-19 policies.
Rabushka has since been unable to take the exam due to the defendant's refusal to accommodate for her disability. She requests the court determine that this violates the Americans with Disabilities Act and issue an injunction requiring the accommodations be provided.
