Railway company sued by driver that crossed tracks while train approaching, causing collision

ST. LOUIS - Two Missouri residents want the Burlington Northern and Santa Fe Railway Company to pay after they allegedly tried to cross railroad tracks while driving and were struck by a train.

The complaint was filed on August 6, 2020, in the City of St. Louis Circuit Court by plaintiffs Kendra Trotter and Andray Jones, and was removed to federal court on May 5. 

On August 9, 2015, Trotter was driving with Jones in the passenger seat northbound on Hall St. near the intersection with Thatcher St. in St. Louis. 

The plaintiffs attempted to cross railroad tracks owned and operated by the defendant, when a westbound train operated by defendant Christopher Bertholomey struck the vehicle, injuring the plaintiffs. 

The plaintiffs allege that Bertholomey did not sound a horn, ring a bell or use a whistle to alert them to the train's presence, and accuse the conductor of doing nothing to avoid them on the tracks. 

The defendants are charged with negligence and respondeat superior. 

The plaintiffs are represented by the Hester Group LLC of St. Louis.
