Woman sues QuikTrip for slipping on banana peel

ST. LOUIS - A woman and her husband are suing after the woman allegedly sustained injuries from tripping on a banana peel in the parking lot.

Julie Hart, and her husband James Hart, filed a complaint on April 19 in the Circuit Court of the St. Louis County against QuikTrip Corporation for negligence and loss of consortium. The defendant removed the case to federal court on May 27.

According to the complaint, Julie Hart tripped on a discarded banana peel in the parking lot of QuikTrip upon exiting her vehicle. Julie Hart allegedly suffered "severe bodily injuries to her left hip and leg" which subsequently resulted in multiple surgeries to repair a torn labrum and two total left hip replacements costing more than $200,000. James Hart alleges suffering loss of consortium, companionship, comfort, instruction, guidance, counseling, training and support of his wife.

The Harts seek monetary compensation for medical expenses, lost wages in excess of $10,000, punitive damages for loss of consortium, court costs and attorney fees. The Harts are represented by Timothy P. O'Mara of Spector, Wolfe, McLaughlin and O'Mara, LLC.
