Three women sue due to Banana Boat sunscreen containing benzene

ST. LOUIS -- Three women claim they would not have purchased Banana Boat sunscreen had they known it had benzene in it and are suing the companies that make the product. 

Lisa Zaya, Catalina Ocampo and Deborah Jean, filed a complaint in the U.S. District Court for the Eastern District of Missouri against Energizer Holdings, Inc., Edgewell Personal Care Company, Edgewell Personal Care Brands, LLC, Edgewell Personal Care, LLC, Playtex Products, Inc., and Sun Pharmaceuticals, LLC, in a class action suit for fraudulent concealment, unjust enrichment and violation of the Illinois Consumer Fraud Act. 

According to the complaint, all three Plaintiffs bought Banana Boat sunscreen at different locations through the United States of America. During the purchase of the sunscreen, none of the Plaintiffs knew that it contained benzene, a known human carcinogen, causing for Banana Boat sunscreen products to not be for human use, the suit says. 

Plaintiffs allege that Banana Boat's line includes 12 different products that have benzene as a ingredient. On May 25, 2021, Valisure filed a citizen petition with the Food and Drug Administration (“FDA”) asking the agency to recall all batches of Defendants’ Sunscreen Products that (as tested) contained 0.1 ppm or more of benzene on the basis that they are adulterated under Section 501 of the Federal Drug and Cosmetics Act, the suit says.

Plaintiffs seek compensatory, statutory, and punitive damages; pre-judgement interest, restitution, attorney's fees and cost of suit. Plaintiffs are represented by Brandon M. Wise of Peiffer, Wolf, Carr, Kane and Conway, LLP
