ST. LOUIS - James Henry Provisions and Cousin Mini Market filed a federal complaint in St. Louis against the United States of America, through its agency, the U.S. Department of Agriculture for judicial review of final agency division and request for a temporary stay.
According to the complaint, the USDA wishes to to permanently disqualify James Henry and Cousin from participation in the Supplemental Nutrition Assistance Program. On June 23, 2021, the USDA issued a Final Agency Decision to James Henry upholding the USDA’s decision to permanently disqualify James Henry from participation in the SNAP due to Henry allegedly engaging in “trafficking” of SNAP benefits in violation of 7 C.F.R §272.2, according to the complaint.
According to the complaint, each "of the Decisions were based upon the same undercover operation by the USDA, utilizing the same undercover operant. In each case, the undercover operant used improper methods to entrap James Henry and Cousin into violating the provision of the SNAP regulations."
James Henry and Cousins allege that the decisions should be reversed. Plaintiffs are represented by Jay. L. Kanzler, Jr. of Witzel, Kanzler and Dimmitt, LLC.
