ST. LOUIS -- Donavan McKinley filed a federal complaint on August 13 in the Eastern District of Missouri against Aaron Perkins and the City of St. Louis for failure to protect, failure to intervene and municipal liability.
According to the complaint, on December 18, 2016, McKinley was confined as a pre-trial detainee at the St. Louis City Justice Center. During his detainment, McKinley was allegedly severely injured in the incident at issue in this case, as he was physically and sexually assaulted by two fellow detainees.
The assault was so brutal that the attackers were criminally charged, prosecuted and convicted in St. Louis City Circuit Court; and the main attacker has been sentenced to 15 years in the Missouri Department of Corrections for his role in the assault, the suit says. McKinley alleges that it was at the fault of the St. Louis City Justice Center for not protecting him and preventing the events from happening.
McKinley seeks compensatory damages, punitive damages, cost of suit and attorney's fees. McKinley is represented by Evelyn Lewis.
