Woman says black pallet on black carpet at CVS caused injuries

ST. LOUIS - Jennifer and Gary Merritt filed a complaint on June 24 in St. Charles County Circuit Court against Missouri CVS Pharmacy, LLC and a Clayton CVS for premises liability and loss of consortium.

According to the complaint, on April 18, 2021, Jennifer Merritt was inside the CVS Pharmacy to purchase a cell phone-charging cord and Gatorade. While inside, Merritt allegedly tripped and fell on an empty black pallet, about six inches in height, located on a black carpet in a walkway. 

Merritt was caused to suffer injuries to her left leg, left ankle, left foot and right ankle that required emergency medical treatment that included surgery. Merritt’s injuries are allegedly permanent, progressive, painful and disabling.

The Merritts are represented by Andrew S. Martin of the Sumner Law Group, LLC. The defendants removed the case to St. Louis federal court in August.
