Netflix sued over its terms and conditions

ST. LOUIS - Sheila and Dennis Thompson filed a lawsuit on Sept. 13 in St. Louis County Circuit Court against Netflix, alleging that the terms and conditions Netflix makes customers agree to are fraudulent and deceptive.

According to the complaint, the terms impose that customers are not allowed refunds and waive the right to pursue a class action against the company. They also state the company may use any ideas or information provided by customers and that Netflix may change the terms and conditions at any time. 

According to the complaint, Netflix’s terms and conditions are not enforceable and are not a contract binding because Netflix purported to grant itself the power to amend and change them, which renders any agreement illusory and invalid. 

Thompson's seek actual damages, attorney's fees, prejudgment interest and taxable costs and declaratory judgment. Thompson's are represented by Robert Schultz.

Netflix recently removed the case to federal court.
